Welcome to BookingPhone.

These Terms of Service (“Terms”) govern your access to and use of bookingphone.com, including its website, web application, mobile/PWA features, booking tools, account services, availability calendars, phone-number-based profiles, WhatsApp integrations, and related services (collectively, the “Service”).

By accessing or using BookingPhone, you agree to these Terms. If you do not agree, please do not use the Service.

1. About BookingPhone

BookingPhone is a platform that helps users discover services, check availability, request reservations, and communicate directly with service providers.

Depending on the service, BookingPhone may allow users to:

  • search for services by phone number;
  • view available booking periods;
  • submit reservation requests;
  • manage reservations;
  • publish and manage service listings;
  • communicate with service providers;
  • authenticate or verify a phone number using supported third-party services such as WhatsApp.

Unless explicitly stated otherwise, BookingPhone is not the provider of the services listed on the platform.

The actual service is provided by the respective service provider, owner, company, landlord, vehicle rental provider, beauty specialist, or other person offering the service.

2. Eligibility

You must be legally capable of entering into an agreement under the laws applicable to you.

If you use BookingPhone on behalf of a company or another organization, you confirm that you have authority to act on its behalf.

3. Accounts

Some BookingPhone features require an account.

You are responsible for ensuring that the information associated with your account is accurate and up to date.

Your account may be associated with your phone number.

You may not:

  • impersonate another person;
  • use a phone number that you are not authorized to use;
  • create accounts for fraudulent purposes;
  • attempt to access another user’s account without authorization.

You are responsible for activity carried out through your account.

4. Phone Number and WhatsApp Verification

BookingPhone may use phone-number-based authentication or verification.

Where the Continue with WhatsApp feature is available, you may be asked to send a pre-filled verification message from your WhatsApp account to a BookingPhone WhatsApp Business number.

BookingPhone may use information provided by WhatsApp Business Platform, including the sender’s phone number, to verify that the user controls that WhatsApp account.

BookingPhone does not attempt to read your WhatsApp account directly from your device.

Use of WhatsApp is also subject to the terms and privacy policies of WhatsApp and Meta.

5. Service Listings

Users who publish services are responsible for the accuracy of their listings.

This includes, where applicable:

  • service title;
  • category;
  • location;
  • availability;
  • price;
  • description;
  • photographs;
  • contact information;
  • booking conditions;
  • minimum rental or booking periods;
  • service-specific restrictions.

Service providers must not publish misleading, fraudulent, illegal, or intentionally inaccurate information.

BookingPhone may remove or restrict listings that violate these Terms.

6. Availability Information

BookingPhone provides tools that allow service providers to indicate when a service is available or unavailable.

Availability displayed on BookingPhone is based on information provided or managed by the service provider and may change.

BookingPhone does not guarantee that a displayed period will remain available until the reservation is accepted or confirmed.

7. Reservations

A reservation submitted through BookingPhone may have different statuses, including, for example:

  • pending;
  • confirmed;
  • declined;
  • cancelled.

Submitting a reservation request does not necessarily mean that the reservation has been accepted.

A reservation becomes confirmed only when the applicable booking flow indicates that it has been accepted or confirmed.

The service provider remains responsible for fulfilling the reservation.

8. Relationship Between Users and Service Providers

BookingPhone facilitates contact and booking between users and service providers.

Unless expressly indicated otherwise, BookingPhone:

  • is not a party to the agreement between the customer and the service provider;
  • does not own or operate the listed apartments, vehicles, or other services;
  • does not guarantee the quality of a service;
  • does not guarantee that a provider or customer will complete a transaction;
  • is not responsible for disputes between customers and service providers.

Any final commercial terms may be agreed directly between the customer and the service provider.

9. Prices and Payments

Prices displayed on BookingPhone are provided by service providers unless otherwise stated.

Service providers are responsible for ensuring that displayed prices are accurate.

Unless BookingPhone explicitly introduces a payment service for a specific transaction, payment arrangements are made directly between the customer and the service provider.

BookingPhone is not responsible for cash payments, bank transfers, deposits, refunds, or other payments made directly between users.

10. User Responsibilities

When using BookingPhone, you agree to:

  • provide accurate information;
  • use the Service lawfully;
  • respect other users;
  • submit genuine booking requests;
  • comply with applicable laws and regulations;
  • respect the booking rules established by service providers.

You must not use BookingPhone to interfere with the operation of the platform or the experience of other users.

11. Prohibited Activities

You may not:

  • use BookingPhone for fraud or deception;
  • send spam or abusive booking requests;
  • attempt to bypass security or authentication systems;
  • scrape or systematically extract data without authorization;
  • use automated bots to overload the Service;
  • distribute malware or malicious code;
  • attempt to gain unauthorized access to BookingPhone systems;
  • create fake listings;
  • publish illegal content;
  • infringe intellectual property rights;
  • use the Service to facilitate illegal transactions.

BookingPhone may suspend or terminate access where misuse is detected.

12. Photos and Other User Content

You may upload photos, descriptions, names, and other content related to your services.

You retain ownership of content that you own.

By publishing content on BookingPhone, you grant BookingPhone a non-exclusive license to host, display, resize, process, and use that content as reasonably necessary to operate and promote the Service.

You confirm that you have the right to publish any content you upload.

13. Third-Party Services

BookingPhone may integrate with third-party services including, for example:

  • WhatsApp;
  • Meta;
  • Google Maps;
  • external navigation services;
  • messaging applications;
  • phone or communication services.

These services are operated independently.

Their availability, functionality, and terms are controlled by the respective third-party providers.

BookingPhone is not responsible for interruptions or changes to third-party services.

14. Intellectual Property

The BookingPhone name, website, software, design, branding, interface, and original platform content are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, or commercially exploit BookingPhone software or branding without permission, except where applicable law expressly permits it.

15. Service Availability

We aim to keep BookingPhone available and reliable, but we do not guarantee uninterrupted operation.

The Service may occasionally be unavailable because of:

  • maintenance;
  • technical problems;
  • hosting failures;
  • network problems;
  • security incidents;
  • third-party service outages;
  • upgrades or changes.

We may modify, suspend, or discontinue features where reasonably necessary.

16. Account Suspension and Termination

BookingPhone may restrict, suspend, or terminate an account if the user:

  • violates these Terms;
  • abuses the platform;
  • engages in fraudulent activity;
  • threatens platform security;
  • repeatedly causes harm to other users.

Users may also request deletion of their account where this functionality is available.

Account deletion may result in permanent removal of account data and associated BookingPhone information, subject to legal or technical retention requirements.

17. Disclaimer

BookingPhone is provided on an “as is” and “as available” basis.

To the extent permitted by law, BookingPhone does not guarantee:

  • uninterrupted availability;
  • error-free operation;
  • the accuracy of every listing;
  • the quality of services offered by third parties;
  • successful completion of every reservation;
  • continuous availability of third-party integrations.

Users should independently evaluate service providers before entering into transactions.

18. Limitation of Liability

To the maximum extent permitted by applicable law, BookingPhone will not be liable for indirect, incidental, special, consequential, or similar damages arising from:

  • a transaction between users;
  • cancellation of a reservation;
  • inaccurate information supplied by a service provider;
  • loss or damage caused by a service provider or customer;
  • third-party services;
  • temporary unavailability of BookingPhone;
  • unauthorized use of an account caused by the user’s own actions.

Nothing in these Terms excludes liability that cannot legally be excluded.

19. Indemnification

To the extent permitted by law, you agree to compensate BookingPhone for reasonable losses, claims, or expenses resulting from your unlawful use of the Service, violation of these Terms, or infringement of another person’s rights.

20. Privacy

Use of BookingPhone is also governed by the BookingPhone Privacy Policy.

The Privacy Policy explains how personal information, including phone-number-related information and authentication data, may be processed.

21. Changes to These Terms

We may update these Terms when the Service, legal requirements, or platform functionality changes.

The updated version will be published on bookingphone.com together with the new “Last updated” date.

Continued use of BookingPhone after an update constitutes acceptance of the revised Terms where permitted by law.

22. Governing Law

These Terms are governed by the laws applicable to the operator of BookingPhone, unless mandatory consumer protection laws in your country provide otherwise.

Any dispute should first be addressed by contacting BookingPhone so that the matter can be resolved informally where possible.
